, kwame brown. kwame, or should i say, mr. brown has been placed under curfew and ordered to make weekly visits with court officials. that court order comes earlier today. brown resigned last june after pleading not guilty to bank fraud and a campaign violence. he is not putting himself in the best position ahead of his sentencing and warned him not to tempt fate. and howard brooks should learn his fate tomorrow. brooks was the former campaign consultant who admitted he funneled funds to former friends candidate, sulaimon brown. it was all part of a campaign designed to improve gray's chances in the election. brooks pleaded guilty to obstruction of justice last may. >>> a new study finds americans are losing their religion. this according to a new forum on religion in the public life study that says the number of people identifying themselves was under 50%. 48%. that's the first time the numbers have been below half ever. one reason, about 20% of americans say they have no religious affiliation and that's up 15% in the last five years. >>> a church on capitol hill is up for sale. the tem

, kwame brown, was hauled back into court today where an angry judge gave him a tongue lashing and a curfew for violating the terms of hisrelease. bruce, you say kwame could have gone to jail for all this. >> former council chairman could have gone to jail today, derek. judge richard leon was angry and that might be an under statement. he was more annoyed than anything else with the former council chairman. kwame brown was ordered to appear in court today to explain to the judge why he failed to check in by phone with the court's pretrial division on three separate occasions. that was part of the conditions on personal recognizance, pending. the judge shot back, it's a little too late in the game for that and ordered brown to appear in person and placed him on a curfew from 11:00 at night until 6:30 in the morning. the judge told brown there won't be three strikes, there will be one. and he has already used that and if he comes before the judge again, he will be ordered to jail. sources close to the case say it's part of his plea bargain agreement, he'll get probation for that

governor jerry brown is trying to help by ordering state smog regulators to allow winter blend to be sold in california earlier than usual to bring down prices. winter blend gas isn't typically sold until october 31st. he hopes by selling it now it would increase supplies by bringing down prices. the high prices are changing driving habits. >> i try not to drive unless i really have to. >> i'm grateful and i only use the bike when necessary. >> reporter: the dramatic surge in prices came after a southern california refinery went down a week ago. it came back online friday. analysts say they expect prices to stabilize in the coming days. now this might make you feel a little better this morning. a gas station in long beach has the priciest gas at $6.66 a gallon. it could be worse. >>> it may be a sign of the times, roseville police are investigating the theft of nearly 1,000 gallons of gas from a shell station. stations manager says security cameras caught the thief stealing gas on three different occasions. police say a man in a pickup truck somehow disabled the meter and pumped gas into

governor jerry brown. bob redell joins us live in cupertino. he has more on this ever-growing story in the wrong direction. bob, good morning. >> reporter: good morning to you, jon. yes, this is an emergency move that's also unprecedented. governor jerry brown has directed the california air reboersz boar resources board to allow the immediate production of the winter blend of gasoline. this should immediately increase the supply of gasoline and in theory lower the prices that you are paying at the pump. we're at the 76 station here in cupertino. this is an extreme. they're charging $5.39 for a regular gallon of gas. you can go elsewhere and find it cheaper, but it's still very expensive. here are the latest numbers from aaa overnight. an average gallon of gas in the bay area is around $4.70. if you were to look at those prices and compare them to a week ago, that's a jump of 46 to 47 cents in just seven days. now, usually california doesn't switch to this winter blend until october 31st. the downside of switching early is the blend is not as friend leto the environment. >> the wint

all these big prices. >> reporter: california's governor jerry brown agrees it's an emergency. so he authorized an immediate switch to winter blend gasoline which can be more polluting but could soon bring down prices by 15 cents to 20 cents a gallon. relief drivers say they need. >> i had to cut back on the groceries in order to get some gas in order to get to work, get the kids to school. >> reporter: prices went up so quickly last week they sometimes seemed to change by the hour. >> in a week it's gone up about 52 cents. absolutely unprecedented from our perspective. >> reporter: the sharp rise was blamed on the supply squeeze that began after a fire shut down part of a chevron refinery in august. then a power failure knocked out an exxon refinery last week. with both refineries now back in operation, wholesale prices on the stock market have already started going down. when wholesale prices go up, the price at the pump seems to rise immediately. but when wholesale prices drop, there's usually a lag at the pump. so california drivers are likely to be paying near record high prices

. wholesale gas prices fell today after california governor jerry brown yesterday eased the state's gas-blend requirements. the change allows refiners to start processing a less- expensive winter fuel blend today, about three weeks ahead of schedule. california's strict air quality standards require a specific gasoline blend that's not necessary in other states, resulting in only a handful of refiners making it. the price spike came after a power outage at an exxon refinery reduced the state's production. in texas, b.p. announced today it is selling its texas city refinery. marathon petroleum is buying it for $2.5 billion, including the oil supplies on sight. this refinery was the sight of a deadly explosion in 2005, leading to a record fine against b.p. for safety failures. >> susie: those high gasoline prices could keep americans home this holiday season. but, it may not mean holiday stockings will go empty. according to a variety of retail sources, americans plan to do a lot of their shopping in the comfort of their own homes, online. in fact online sales could be a bright spot in an
